Welcome to BrandDefender.ai (hereinafter referred to as "this Service"). This Service is operated by Wolin Global Media Co., Ltd. (hereinafter referred to as "the Company"). By using this Service, you acknowledge that you have read and agree to all terms and conditions set forth herein.
1. Acknowledgment & Acceptance of Terms
- These Terms constitute the entire agreement between you and the Company. If you do not agree with any part of these Terms, please discontinue use of this Service immediately.
- The Company reserves the right to modify these Terms at any time. Updated Terms will be posted on the website. Significant changes will be communicated via email or website announcement.
2. Scope of Services
The Company provides the following services:
- AEO / AI SEO Optimization: AI brand audits, AEO optimization analysis, JSON-LD structured data deployment, and AI search visibility monitoring.
- AI Chatbot Development & Managed Services: LINE AI chatbot setup, knowledge base construction, security testing, ongoing maintenance, and monthly reports.
- Free Tools: Brand AI Perception Scanner (app.aibranddefender.com).
3. AI Service Disclaimer (Important)
- Limitations of AI-Generated Content: Analysis results and AI chatbot responses provided by this Service are generated by artificial intelligence models. You expressly acknowledge that AI may produce inaccurate, outdated, or incomplete information (commonly known as "AI hallucination"). Reports and AI responses from this Service are for reference only; the Company does not guarantee their absolute accuracy.
- Scope of Managed AI Chatbot Responsibility: The Company is responsible for the technical setup, knowledge base maintenance, and security of the AI chatbot. AI chatbot responses are based on knowledge base data provided by the client; the Company is not responsible for the accuracy of client-provided data.
- No Guarantee of Results: The Company does not guarantee that using this Service will directly improve your AI search rankings, traffic, or revenue. AEO optimization results are affected by multiple factors including AI model updates, competitor activities, and market changes.
- Service Modifications: The Company may modify, suspend, or discontinue certain service features at any time due to technical adjustments (such as third-party AI model API updates or pricing changes), with advance notice provided.
4. User Obligations & Prohibited Conduct
To maintain service quality and security, you agree not to engage in the following activities. Violations may result in immediate service termination without notice or refund:
- Resource Abuse: Using automated programs (scripts, crawlers), bots, or malicious attacks, or excessively frequent API calls that affect system operations.
- Infringement: Reverse engineering, cracking, decompiling this Service, or plagiarizing its interface design or AI prompts.
- AI Chatbot Abuse: Conducting Prompt Injection attacks, attempting to extract system instructions, or using the AI chatbot to generate fraudulent, violent, pornographic, or other illegal content.
- Harassment & Illegal Activity: Verbally abusing or harassing customer service staff, or using this Service for any illegal activities.
- Account Sharing: Transferring, renting, or lending your account to others.
5. Payment & Refunds
- Billing: AEO optimization services are quoted on a project basis; AI chatbot services are billed as setup fee plus monthly maintenance fee. Actual costs are based on the post-consultation agreement.
- Digital Product Nature: Given the immediacy of digital services, once this Service is activated or used (including API calls or AI chatbot going live), refunds are generally not available unless otherwise required by law.
- Fraudulent Chargebacks: In cases of malicious credit card chargebacks, the Company will permanently freeze the associated account and reserves the right to pursue legal action.
6. Intellectual Property
- All content of this Service (including code, trademarks, analysis report formats, website design, and AI prompt architectures) is owned by the Company. Unauthorized reproduction or commercial use is prohibited.
- In managed AI chatbot services, intellectual property of knowledge base content provided by the client remains with the client. The Company uses such content only within the scope of services.
7. Data Security & Confidentiality
- The Company commits to protecting your data security with reasonable technical and administrative measures, including transmission encryption (TLS 1.3), access control, and regular security audits.
- In managed AI chatbot services, client knowledge base content and end-consumer conversation data will be strictly kept confidential and will not be disclosed to third parties.
- In the event of a data security incident, the Company will notify affected individuals and report to the competent authority as required by the Personal Data Protection Act.
8. Service Interruption & Limitation of Liability
- The Company shall not be liable for service interruptions caused by force majeure events such as natural disasters, network outages, or third-party service failures (Google / Anthropic / OpenAI / LINE).
- If the Company is legally required to provide compensation, the maximum liability is limited to the total service fees paid by you in the six months preceding the occurrence of damage.
9. Governing Law & Jurisdiction
These Terms are governed by the laws of the Republic of China (Taiwan). Both parties agree that any disputes arising from these Terms shall be subject to the jurisdiction of the Taiwan New Taipei District Court as the court of first instance.
